By using this website or contacting Morgan Hill Asphalt Paving for services, you confirm that you are at least 18 years old and have the legal capacity to enter into a binding agreement. These terms apply to all visitors, customers, and others who access or use our website or services.
Morgan Hill Asphalt Paving provides asphalt paving, sealcoating, repair, striping, and related services for residential and commercial properties in the Morgan Hill, CA area and surrounding communities. Services are performed by appointment and are subject to availability.
We reserve the right to decline any service request at our discretion, including requests that are outside our service area, scope of expertise, or operational capacity.
All estimates are provided at no charge and are based on information gathered during an on-site visit. An estimate is not a binding contract. Actual project costs may differ from estimates if conditions at the site differ materially from those observed during the estimate visit, if additional work is requested, or if unforeseen conditions are discovered during the project.
Any changes to the scope of work that affect the project price will be communicated to you before the additional work is performed. We will not perform work beyond the original estimate without your prior approval.
Prices quoted are valid for the period specified in the written estimate. Prices are subject to change if work is not scheduled within that period.
Work is scheduled by mutual agreement. We will make reasonable efforts to confirm the scheduled date in advance. We reserve the right to reschedule due to weather conditions, equipment issues, or other circumstances outside our control. We will notify you as early as possible in those situations.
If you need to cancel or reschedule, please notify us at least 48 hours in advance. Cancellations made with less than 48 hours notice may be subject to a cancellation fee if materials have already been ordered or mobilization costs have been incurred.
We are not responsible for delays or cancellations resulting from acts of nature, government orders, labor shortages, material unavailability, or other events beyond our reasonable control.
Payment terms will be specified in the written agreement for each project. Unless otherwise agreed in writing, payment is due upon completion of the work. We accept cash, check, and electronic payment methods as specified in the project agreement.
For larger projects, we may require a deposit before work begins. Deposit requirements will be stated clearly in the written agreement before any work is scheduled.
Accounts not paid within the agreed timeframe may be subject to a late payment fee and may be referred to a collection agency. The customer is responsible for any collection costs or attorney fees incurred to recover unpaid amounts.
We stand behind our work. Any warranty applicable to a specific project will be stated in the written project agreement. Warranty claims must be submitted in writing within the warranty period.
Warranties do not cover damage resulting from misuse, abuse, neglect, accidents, acts of nature, tree root intrusion, subsurface soil movement, or modifications made by parties other than Morgan Hill Asphalt Paving.
The customer is responsible for keeping vehicles and equipment off new asphalt surfaces for the cure period specified at the time of installation. Failure to do so voids any workmanship warranty.
EXCEPT AS EXPRESSLY STATED IN A WRITTEN PROJECT AGREEMENT, ALL SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

You are responsible for locating and marking all underground utilities, sprinkler systems, and other sub-surface features before work begins. Morgan Hill Asphalt Paving is not liable for damage to unmarked utilities or sub-surface features.

These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding relating to these terms or services will be brought exclusively in the courts located in Santa Clara County, California.
